1. Introduction

Welcome to Every Putt Counts (the “App”). These Terms of Use (“Terms”) govern your access to and use of the App provided by Every Putt Counts (“we,” “our,” or “us”).

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

You represent and warrant that you have all necessary rights to the content you provide and that it does not infringe or violate any third-party rights or applicable laws.

4. Intellectual Property

The App and all content, including but not limited to text, graphics, logos, software, and other materials, are owned by us or our licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, create derivative works, reverse engineer, or exploit any part of the App or its content without our prior written consent.

5. Disclaimers and Limitation of Liability

5.1 No Warranty

The App is provided “as is” and “as available.” We make no warranties, express or implied, regarding the App, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, secure, available at all times, or error-free.

5.2 No Performance Guarantee

The App is intended for informational, practice, and training purposes only. We do not guarantee any specific golf performance improvements, scoring outcomes, or other results from using the App.

5.3 Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.

6. Indemnification

You agree to indemnify, defend, and hold harmless Every Putt Counts, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or related to:

Your violation of these Terms

Any content you provide

7. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice.

You may terminate your account at any time by using the account deletion feature within the App.

Upon termination, your right to use the App will immediately cease. Certain provisions of these Terms, including intellectual property rights, disclaimers, limitations of liability, and indemnification, will survive termination.

8. Changes to These Terms

We may update these Terms from time to time. When changes are made, we will update the effective date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

9. App Store Terms

If you access the App through the Apple App Store or Google Play Store, you acknowledge that:

These Terms are between you and Every Putt Counts, and not with Apple or Google

Apple and Google are not responsible for the App or its content

Apple and Google have no obligation to provide maintenance, support, or other services for the App

You must comply with all applicable third-party terms when using the App, including the terms of the Apple App Store or Google Play Store

10. Subscriptions and Billing

Some features of the App may require a paid subscription.

Subscriptions are billed through your Apple App Store or Google Play account and will automatically renew unless canceled in accordance with the applicable app store’s billing terms.

You can manage or cancel your subscription at any time through your Apple App Store or Google Play account settings.

We do not process payments directly and do not store your full payment information. Billing, renewals, and refund requests are handled by Apple or Google, depending on the platform you use.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Idaho, United States of America, without regard to its conflict of law principles.
